Access to this website and its use are subject to the following conditions, as well as to the legal provisions in force. By accessing the website, you accept these terms without limitation or reserve. When purchasing from the website, you accept these terms and conditions expressly by clicking on the corresponding button. It is not technically possible to place an order without confirming this acceptance.

 

1. Copyright

The content of this website, including the name and logo of the company Genevacakes, is protected by copyright. No document available on this website, or any part of it, may be stored, transmitted by any means (including, but not limited to, electronic, mechanical, scanning, photocopying or recording), republished or misappropriated. Genevacakes reserves the right to take measures in the event of the misuse of the material available on this website.

 

2. Privacy Policy, see full data protection information

We will not sell, give away, or otherwise share your information with third parties. The information we collect about you is only for the purpose of processing your order and to provide you with the best possible service. If you are registered on our mailing list, you can unsubscribe at any time by logging into your account.

 

3. Jurisdiction and applicable law

These terms and conditions are governed and interpreted in accordance with Swiss law. All legal relationships between Swisscakes SàRL and the customer are subject to Swiss law. The exclusive place of jurisdiction is Geneva.

4. Refunds and returns

We take great care when packaging your goods and sending them to you. If your package is damaged in transit, please notify your local post office as soon as possible and ask them to assess the package for you. Genevacakes will not be held responsible once your package has left our premises. Our products are guaranteed new out of the factory.

(new, change made on 05.01.23) Swiss law does not provide for any legal right to return a purchased item, except in the case of a defect. On our site, you still have 7 days from receipt of your order to request a return. Edible, reduced price, seasonal or custom-made products are excluded from the right of return. Any returned product must be in its original packaging, complete with all the items, as you received it, and must not have been used or damaged in any way. The return costs are at the customer's expense.

Please write a message in the box with your order number, your name, first name and the reason for the return (you can use the delivery note and annotate it). Once we receive your package, we will check the condition of the returned product. The processing time for returns may vary and take a few days. If everything is in order, a voucher (not a direct refund) will be sent to you by e-mail for the value of the returned product. This refunded amount excludes the initial shipping costs. If you do not receive anything within a week after we received your package, please check your spam.

5. Products

The descriptions and prices shown on our website are guaranteed, subject to availability or error. Colours may vary depending on screens and the light. We only deliver to addresses in Switzerland and Lichtenstein excluding Büsingen, Campione d’Italia, Samnaun. Food products are normally shipped 1 month before their best before date. Some discounted products have shorter dates that are clearly indicated in the product description. In the event of a stock issue, you will be contacted to find a solution, e.g. replacement product, refund or second shipment. Delivery of your order may be delayed while we wait for your answer.

6. Delivery

Your order cannot be changed or modified once it has been confirmed. Any orders not paid for or collected are cancelled after 1 week. 

All orders placed before 12.30pm will be despatched on the same working day (or the next working day). In case of a stock issue, you will be contacted to find a solution. Deliveries are made by Swiss Post. Special requests (leave the package at the neighbor's, in the garage, ...) must be communicated to your postman or post office. Delivery times may vary around public holidays, depending on the availability of the Swiss Post or when special times are announced for the shop.

Delivery charges are calculated automatically and will be displayed in your basket before payment. We take great care when packaging your order and sending it to you. In the event that your package has been damaged in transit, please notify your local post office as soon as possible and ask them to assess the package for you. Genevacakes will not be held responsible once the parcel has left our premises. The delivery times of the Swiss Post are given as an indication, we are not responsible in the event of delay related to the Post. You will receive a tracking number when the parcel is dispatched, if the delivery method you have chosen offers this.

If the post office returns a package for one of the following reasons: the addressee does not live at the address shown or the package has not been collected, the customer will receive a credit for the value of the goods minus the postage (delivery and return).

 

 

7. PAYMENT BY INVOICE WITHIN 30 DAYS with our Partner SWISSBILLING.

 

SWISSBILLING SA is a service provider that allows you to pay for your order by invoice in a simple and secure way.

The invoice will be sent from SWISSBILLING separately from your order, by email or regular mail as requested. If you are collecting your order in-store, the invoice will be sent 24 to 48 hours after your order has been prepared. Under NO CIRCUMSTANCES will you be able to pay in cash at the store as the money will already be owed to Swissbilling.

SWISSBILLING’s services are based on a fixed fee. The maximum amount for a first purchase with SWISSBILLING is CHF 850.00. The invoice is payable within 30 days. For security reasons, the billing and delivery addresses must be identical. SWISSBILLING reserves the right to have a credit check carried out through its partner CRIF AG in Zurich (Tel.: 0848 333 222, www.crif.ch).

Invoices are sent separately from the order, 48 hours after it has been placed, by email or regular mail, as requested. The package containing your order will not include our invoice in addition to the delivery note. If you are collecting your package from our store, a signature will be required.

Packages will require a signature on delivery.

Invoices are payable at 30 days. In the event of a delay, a reminder fee of CHF 15.- may be claimed.

By using the SWISSBILLING payment method, you agree that SWISSBILLING SA:

  •       may use your personal data for billing purposes;
  •       this data will be treated confidentially and not transmitted to third parties, with the exception of the merchant, who must be able to access the data of your order and its status;
  •       may check your credit score with the CRIF AG database in Zürich and pass on, if applicable, your payment deadline.

8. Cancellation of private workshops:

Cancellation by the customer, up to 2 weeks before the course: free, full refund;

Cancellation by the customer, up to 1 week before the course: refund of 50% of registration fees;

Cancellation by the customer, less than 1 week before the course: course fees are not refundable;

Cancellation by Genevacakes: participants are fully reimbursed. We reserve the right to cancel the course if fewer than 4 participants are registered. In this case, we either offer a full refund or the option to choose another course.

 

 

9. Cancellation of Master Class courses:

 

Cancellation by the customer, up to 4 weeks before the course: free, full refund; 

Cancellation by the customer, up to 2 weeks before the course: refund of 50% of registration fees;

Cancellation by the customer, less than 2 weeks before the course: course fees are not refundable;

Cancellation by Genevacakes: participants are fully reimbursed. We reserve the right to cancel the course if fewer than 4 participants are registered. In this case, we either offer a full refund or the option to choose another course.

 

 

10. Order cancellations

Orders not paid for by bank transfer within 1 week will be automatically cancelled.
